Running a trade business in Germany: the Meister system and strong payment security

Germany filters who may run a trade business through the Meister system, then hands contractors one of the strongest payment protections in Europe. Here is how it fits together in 2026.

Meisterpflicht: who may open the doors

Trades listed in Anlage A of the Handwerksordnung, including electrical, plumbing and heating (Installateur und Heizungsbauer), carpentry and roofing, may only be run by businesses with a Meister, either the owner or an employed technical manager. Twelve trades regained Meisterpflicht in 2020 and the framework is stable into 2026. Alternatives exist: the Altgesellen route recognises six years of experience including four in a leading position for many trades, and EU qualification recognition applies cross-border. Every craft business registers with its Handwerkskammer in the Handwerksrolle.

Getting paid: 650f BGB and friends

German law gives building contractors the Bauhandwerkersicherung (section 650f BGB): on most private construction contracts you can demand security, typically a bank guarantee, for your contract sum, and suspend work or terminate if the client does not provide it. Combined with statutory abschlagszahlungen (progress payments) and default interest, a contractor who uses these rights rarely carries the credit risk quietly accepted elsewhere. VOB/B terms are standard on commercial work and modify the BGB rules, so know which regime each contract runs under.

Money and people obligations

Construction businesses join BG BAU for mandatory accident insurance and, in most construction sectors, pay SOKA-Bau levies funding holiday and training schemes. Minimum wage rules for construction and posted worker obligations apply to cross-border crews.

VAT: the 13b reverse charge

Standard VAT is 19%. Between businesses that both provide construction services, the section 13b UStG reverse charge shifts VAT accounting to the recipient, and the invoice must say so. Applying it when it does not apply, or missing it when it does, creates genuine tax exposure, so confirm each B2B customer's status, ideally with their Freistellungsbescheinigung, which also spares you the 15% construction withholding tax on payments.
